The Founder of Price Law Firm in Redlands outlined critical areas a person needs to ask about before investing their time and effort in legal family matters.
One crucial matter is the attorney's fees for their services. "If a law firm cannot estimate how much it will cost to put a plan together, it's a red flag that you may overpay," he said. "Many may shy away from asking about money. However, it's essential to be upfront and ask how an attorney bills for their services."
Mr Price said: "Ask attorneys whether they bill by the hour or charge flat fees. Most of the time, a person will want a lawyer who charges a flat fee per project instead of charging hourly."
Establish what the service includes and whether it covers regular estate plan reviews. Mr Price said: "The reality is that as life changes, such as births, deaths, marriages and divorces, your legal documents, such as wills, plans and trusts, need to be updated to remain accurate and valid.’’
"It's important to keep plans up to date, so regular reviews of your documents are imperative. You'll want a lawyer who will not charge extra to review them regularly, such as every 3-5 years."
Choosing a law firm that offers proactive communication with clients is also vital. "Changes in the law occur, and some lawyers are not best at communicating with clients," he revealed. "It's a good idea to ask if they offer regular updates with you every couple of months via email."
He added that asking about the nature of the law firm is also essential when selecting an elder law planning attorney. "You'll have an ongoing relationship with your lawyer for your estate plan, so question what happens if they die or retire. You'll feel better knowing the firm has a plan to provide ongoing legal help. The last thing you want is to start over, which can be a costly and time-consuming exercise."
Mr Price concluded: "Those thinking of elder law estate planning need to be thorough in their assessment when choosing the right attorney as every estate plan is different and complex."
