Oakland County Misdemeanor Attorney Paul J. Tafelski Discusses Misdemeanor Cases in the State of Michigan

Jul 11, 2022

July 11, 2022 - /PressAdvantage/ - Oakland County misdemeanor attorney Paul J. Tafelski releases a new article explaining misdemeanor cases in the State of Michigan. The lawyer mentions that while a misdemeanor may be considered relatively minor, it can still be quite a serious matter. Even though the jail term for a misdemeanor is relatively shorter, a defendant can still face hefty fines and even probation.

According to the Oakland County misdemeanor attorney, “The difference in a sentence from one judge to the other, even in the same courthouse, can be extreme. To gain an advantage in fighting the charges and obtaining a favorable outcome, it’s best to hire an experienced Michigan criminal defense attorney as soon as possible.”

The lawyer mentions that Michigan misdemeanors differ from felonies due to the severity of the circumstances, the amount of property that was stolen, or the number of controlled substances that were in the defendant's possession.

Attorney Paul Tafelski adds that there are three types of misdemeanors: 93-day, one-year, and two-year/high court misdemeanors. A 93-day offense is a violation of certain laws in a state or locality. This category includes assault, battery, embezzlement of less than $200, as well as lower levels of retail fraud.

Attorney Tafelski states that one-year misdemeanors can result in one year of imprisonment and a maximum $1000 fine. Shoplifting and theft of property between $200 and $1000 are all considered one-year misdemeanors.

“Two-year misdemeanors are crimes that bear some of the characteristics of misdemeanors but are also similar to certain lower-level felonies. Examples of offenses in this category would be resisting arrest or possession of some narcotic medications without a prescription. A conviction may mean up to two years in jail,” says the defense lawyer.

Lastly, the lawyer emphasizes the importance of having a skilled lawyer when facing a misdemeanor offense. An experienced lawyer may be able to help the defendant understand their rights and protect their freedom.
